General terms and conditions

These General Terms govern the sale of products through the website https://fiakers.com and its associated domains of Fiakers (hereinafter, the "Site"), also referred to as the "Shop". By placing an order, you declare that you have read, understood and accepted these Terms.

2. Scope of application

These Terms apply to the sale of bean bags, covers, fillers and related accessories sold in the Shop to consumers under Spanish Royal Legislative Decree 1/2007 of 16 November (TRLGDCU) and EU consumer protection legislation. If you are acting as a business or professional, please contact us before placing your order.

3. Capacity and minimum age

To contract in the Shop you must be at least 18 years old and have sufficient legal capacity. If you are a minor, you may only purchase with the authorisation of your parents, guardians or legal representatives.

4. Purchase process

The purchase process generally includes the following steps:

• Selection of products and, where applicable, configuration of variants (size, fabric, colour or other available options).
• Adding items to your cart and reviewing the order summary.
• Entering or confirming shipping and billing details.
• Acceptance of these General Terms and, where applicable, the Privacy Policy.
• Payment of the total price using the methods enabled in the Shop.
• Receipt of the order confirmation email.

Order confirmation constitutes acceptance of the offer and the formation of the sales contract, unless we notify you of an error relating to availability, price or other essential data, in which case we will inform you as soon as possible.

5. Prices, taxes and currency

• Prices shown in the Shop include Value Added Tax (VAT) or other applicable indirect taxes, unless expressly stated otherwise.
• Prices may vary depending on product configuration (for example, surcharges for size or fabric). The final price will be displayed before you confirm your order.
• Shipping costs will be clearly indicated before payment. We currently offer free shipping to the destinations promoted on the Site, without prejudice to possible geographic exclusions indicated during checkout.
• The contract currency will be that displayed in the Shop (usually EUR, or another currency enabled for certain markets).

6. Payment methods

We accept the payment methods indicated during checkout (card, bank transfer or others we may enable). The charge will be made when you confirm the order or within the period indicated for each method. We reserve the right to cancel orders in the event of pricing errors, detected fraud or inability to verify payment.

7. Shipping and delivery times

We ship mainly to countries in the European Union. Estimated delivery times are indicated during checkout and in the confirmation email. We are not liable for delays attributable to carriers, customs (for exceptional shipments outside the EU) or force majeure, although we will keep you informed where possible.

The risk of loss or damage to the products passes to you at the moment of physical delivery to the recipient indicated.

8. Availability and configurable products

Product images and descriptions are for guidance only. Some items may be configured by size, fabric, colour or other options. Availability is shown in real time where possible; if a combination is out of stock, you may subscribe to a stock alert in accordance with our Privacy Policy.

Custom-made products or items manufactured to the specifications you choose may be subject to additional production times, which we will communicate before confirming your order where applicable.

9. Right of withdrawal

If you are a consumer, you have the right to withdraw from the contract within 14 calendar days of receiving the goods, without giving any reason, in accordance with Article 102 et seq. of the TRLGDCU and EU consumer law.

To exercise your right of withdrawal, you must notify us of your decision unequivocally before the deadline expires, for example by email to info@fiakers.com or in writing to our postal address, stating your name, address, order number and the products you wish to return.

You must return or hand over the products without undue delay and, in any event, no later than 14 calendar days from notifying us of your withdrawal. Direct return costs will be borne by you, unless we indicate otherwise or the product delivered was faulty or did not match what you ordered.

We will refund all payments received, including standard delivery costs (not additional costs for a delivery type other than the least expensive standard option), without undue delay and, in any event, no later than 14 days from when we receive the returned goods or proof of their dispatch.

9.1. Exceptions to the right of withdrawal

Under Article 103 of the TRLGDCU, you will not have a right of withdrawal, among other cases, for:

• Goods made to the consumer's specifications or clearly personalised (for example, colour, fabric or size combinations expressly chosen by you and not available as a standard in-stock product).
• Sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.
• Goods that, after delivery, have been inseparably mixed with other items.

10. Legal warranty and conformity

Products sold in the Shop are subject to the legal warranty of conformity under Articles 114 et seq. of the TRLGDCU. You have a period of three years to demand repair, replacement, a price reduction or termination of the contract when the product is not in conformity with the contract.

To exercise your warranty rights, contact us at info@fiakers.com with your order number, a description of the defect and, if possible, photographs. We will explain the procedure for collection, repair, replacement or refund as applicable.

11. Intellectual and industrial property

All Site content (texts, images, logos, designs, software and databases) is owned by Fiaka Ambient, S.L. or third-party licensors and is protected by intellectual and industrial property law. Reproduction, distribution or transformation without express authorisation is prohibited.

12. Use of the Site

You agree to use the Shop lawfully, without introducing viruses, attempting unauthorised access or using the content for fraudulent purposes. We may suspend access for users who breach these obligations.

13. Liability

Fiaka Ambient, S.L. shall not be liable for damage arising from misuse of the products, temporary Site interruptions due to maintenance or technical causes beyond our reasonable control, or content on third-party websites linked from the Shop.

Nothing in these Terms limits the non-waivable rights granted to you under applicable consumer law.

14. Online dispute resolution

Under Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/. You may use it if you wish to attempt an out-of-court solution. Our contact email for this purpose is info@fiakers.com.

15. Applicable law and jurisdiction

These Terms are governed by Spanish law. For the resolution of disputes, the parties submit to the courts of the consumer's place of residence where mandatory law so provides; otherwise, to the courts of Granada (Spain), with express waiver of any other jurisdiction that might apply, save for mandatory jurisdiction.

16. Amendments

We may update these General Terms to reflect legal, commercial or technical changes. The version applicable will be that published on the Site at the time you place your order, unless the law requires otherwise.
